Terms of Service

1. Agreement to These Terms
These Terms of Service ("Terms") govern your use of Shinsei, including our mobile app, website, and related services (collectively, the "Service"). By creating an account, using guest mode, or otherwise using the Service, you agree to these Terms.
2. Eligibility
You must be at least 16 years old to use Shinsei. By using the Service, you confirm that you meet this requirement and can enter into a binding agreement under applicable law.
3. Accounts and Access
You may access Shinsei through account registration (including Apple Sign In) or through limited guest mode. You are responsible for account security and for activity under your account. We may suspend or terminate access if we reasonably believe there is abuse, fraud, or violation of these Terms.
4. Nature of the Service
Shinsei provides AI-assisted self-reflection features such as signals, actions, archetypes, and insights. Outputs are generated from your interactions and model inference, may be inaccurate, and are provided for reflection/entertainment. They are not medical, mental health, legal, financial, or other professional advice, and are not a diagnosis or treatment.
5. Acceptable Use
You agree not to misuse the Service, including by interfering with operation, attempting unauthorized access, scraping in violation of law, reverse engineering where prohibited, or using Shinsei to create unlawful, harmful, or abusive content or behavior.
6. Subscriptions and In-App Purchases
Some features may require a paid subscription purchased via the Apple App Store. Billing, renewals, cancellations, and refunds are handled by Apple under its terms. Shinsei does not receive or store your full payment card data.
7. Intellectual Property
The Service, including software, branding, and non-user content, is owned by Tsimafei Launik (sole proprietor, Poland) or licensors and is protected by law. We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms.
8. Third-Party Services
The Service may rely on third-party providers (for example app stores, cloud hosting, AI processing, push notifications, analytics, and error monitoring). Your use of third-party services is also subject to their terms and policies.
9. Privacy and Cookies
Your use of the Service is also governed by our Privacy Policy, which explains how we collect and process personal data. When you visit our website, we set a small number of functional cookies as described in the Privacy Policy (section 11). By continuing to use the website you acknowledge this use. You can remove or block cookies at any time via your browser settings.
10. Disclaimer of Warranties
The Service is provided "as is" and "as available" to the maximum extent allowed by law. We do not guarantee uninterrupted operation, specific outcomes, or error-free AI outputs.
11. Limitation of Liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or loss of data, profits, goodwill, or business interruption. Our total liability for claims arising from the Service will not exceed the amount you paid us in the 12 months before the claim, or EUR 50 if you paid nothing.
12. Termination
You may stop using Shinsei at any time and may request account deletion from within the app. We may suspend or terminate access for violations of these Terms, legal requirements, or security reasons.
13. Changes to These Terms
We may update these Terms to reflect product, legal, or operational changes. Material updates will be notified in-app and posted here with an updated date.
14. Governing Law
Unless mandatory local law provides otherwise, these Terms are governed by the laws of Poland, without regard to conflict-of-law principles.
